Boston City Councillor John M. Tobin, Jr. is calling on the city’s Inspectional Services Department (ISD) to consider implementing a comprehensive warning notification system for all illegal violations under its jurisdiction.

Councillor Tobin filed an order at the City Council’s weekly meeting today calling for a public hearing to explore the issue.

According to Councillor Tobin, his office received several calls from constituents who were being fined by ISD for having illegal driveways and curb cuts on their properties that were more than 10 years old. Residents who wanted to challenge the violations were told to file appeals at Boston Division of the Massachusetts Housing Court.

“Going to court should not be the first step,” said Councillor Tobin, who represents West Roxbury and Jamaica Plain. “If we simply issued warning notices we would give residents an opportunity to assess the situation and figure out how to address it without going directly to Housing Court.”

The only written warnings currently issued by ISD’s Code Enforcement Division are for site cleanliness problems at homes and businesses.

The order will be sent to a City Council Committee and a public hearing will be scheduled.
